What is No Win No Fee?

The term “No Win No Fee” is another way of describing a Conditional Fee Agreement (CFA). This is an agreement made between a solicitor and their client which states exactly how the injured party will not be charged legal costs in an unsuccessful case.

Solicitors can afford to offer No Win No Fee agreements to our clients because we provide them with a type of insurance, called After the Event (ATE), which covers them if the case they are running for a defendant ends in defeat. They always take this out if they believe legal proceedings will be required to get the compensation you are entitled to following an accident that wasn’t your fault.

If you claim is successful then you don’t pay a penny either. Instead the legal costs will be charged to the losing side; separate to your compensation award. This means you receive 100% of your compensation and your solicitor does not take a proportion of it for their costs.

(Please note that this does not apply in claims submitted to the MIB for uninsured/untraced driver accident, and claims submitted to the CICA for criminal assault).

No Win No Fee Claim Types

Here the awards are much more set-in-stone and are agreed on a tariff basis.
