The Compensation Claims Process and Procedures

If you believe you are entitled to make a claim for compensation then there are two steps you could take:

During your initial conversation you will be able to talk to your claims handler about your accident, including how it was caused and what injuries you suffered as a result. They will then inform you about how our service is run and what, if you are happy to proceed, we will do next to help you get the compensation you are entitled to.

If we believe that you have a valid claim, we will tell you and then look at the next possible steps. We put you under no pressure and there is absolutely no obligation to continue with a compensation claim with us after the initial conversation. However, should you agree, your claims handler will look at passing your details onto a solicitor that specialises with your type of accident claim.

You will be kept updated with progress of finding a solicitor and your claims handler will inform you of the relevant options available. Should you not be entirely satisfied with the choice of solicitor that we believe will be the best for you based on our previous experience with them, then you are well within your rights to select a different legal expert for your claim.

Dealing with a Personal Injury Claim Solicitor


Once a solicitor has agreed to take on your claim you may be required to undergo a medical examination to prove your injuries would make you entitled to compensation. We will organise this for you and help you select a suitable date and time for this to be carried out.

We will also carry out a more detailed conversation with you regarding your accident, in order to prepare a legal statement which your solicitor will use in order to initiate legal proceedings against the party at fault. Again, this can take place on a date and time of your convenience.

This would also be the time to present any evidence that you may have gathered, for example photographs of the area or scene of your accident or statements from witnesses. It’s generally the case that the more evidence your solicitor has available to prove that a third party has been negligent, therefore causing your accident, the quicker a final compensation settlement will be made.

It may be required for you to complete some paperwork, agreeing to the statement you have given us, as well as signing a conditional fee agreement. This is another name for what is more commonly known as No Win No Fee – meaning you are protected financially in the event your case is unsuccessful.
